This document is an electronic record in terms of Digital Personal Data Protection Act, 2023 read in conjunction with the Information Technology Act, 2000 and rules thereunder, and is published in accordance with the provisions of Rule 3 (1) under Information Technology Rules which mandates for publishing of rules and regulations, privacy policy and terms of use for access or usage of the Site. This electronic record is generated by a computer system and does not require any physical or digital signatures. M/s. Your use/ access of the Site, its related sites and hyperlinks, shall be governed by the terms and conditions, policies, rules of Docube (“Terms of Use“) posted on the Site from time to time. These Terms apply to all users (whether Registered User or guest user) of the Site.

Please read the terms and conditions carefully before using the Site as your use of the Site is subject to your acceptance of and compliance with the terms. If you do not agree or are not willing to be bound by the terms and conditions of this User Agreement and any rules and policies of Docube, please do not click on the “I Accept” button/ check box and on the “Continue” button and do not subscribe or seek to obtain access to or otherwise use the Site.

By subscribing to or using the Site, you agree that you have read, understood and are bound by the terms, policies, directions of Docube regardless of how you subscribe to or use the Site. This Agreement comes into effect upon your “Acceptance” of these terms and conditions. However, Docube at its sole discretion reserves its right not to accept a user from registering on the Site without assigning any reason thereof.

Definitions
  • Agreement” means the terms and conditions as detailed herein including all schedules, appendices, annexures, Privacy Policy, any disclaimer herein and will include the references to this Agreement as amended, novated, supplemented, varied or replaced from time to time.
  • You“/ “User” shall mean the end user accessing the Site, its contents and using the services offered through the Site.
  • Docube”/ “we”/ “us”/ “our” shall mean Docube or its affiliates, franchisees, service providers, successors and assigns.
  • Site”/ “Website” means the online shopping platform Site: www.docube.in owned and operated by Docube.
  • “Acceptance” shall mean your affirmative action in clicking on “Checkout” and on the “Continue” button as provided on the registration page or clicking on “Pay Now” button while transacting as User or such other actions that implies your acceptance.
  • “Content” means all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code collectively.

By impliedly or expressly accepting this User Agreement, Policies and Terms, You also accept and agree to be bound by rules, Policies (defined hereinbelow) and Terms of Docube as provided from time to time in its Site and corresponding hyperlinks.

REGISTRATION AND SUBMISSION OF PERSONAL DETAILS

You can use the Site as a “Registered User” or as a guest. As a part of the registration process on the Site, you hereby acknowledge and consent to collection of certain personally identifiable information about you including first and last name, email address, mobile phone number and contact details, postal code, demographic profile (like your age, gender, occupation, education, address etc.) and information about the pages on the site you visit/ access, the links you click on the site, the number of times you access the page and any such browsing information. Please note that while certain information may not be requested during the initial registration, it may be request at subsequent stages in your engagement with us. To be a Registered User, the registration process will require you to open an account (“Account”) to furnish the aforementioned information as part of onboarding you as a Registered User.

As a Registered User, you are responsible for maintaining the confidentiality of your user id and password. You are also responsible for maintaining the confidentiality of your email id and mobile number and for restricting access to your computer, computer system and computer network, and you are responsible for all activities that occur under your user id and password, email id and mobile number as the case may be. You agree to maintain and promptly update all data provided by you and to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the Terms, we have the right to indefinitely suspend or terminate or block access of your user account with the Site and refuse to provide you with access to the Site. We will collect personally identifiable information about you only as part of a voluntary registration process, on-line survey, or contest or any combination thereof. You hereby agree to immediately notify Docube of any unauthorised use of your User account, related information or any other breach of security. Docube shall not be liable for any loss or damage arising from User failure to comply with this provision. Users may be held liable for losses incurred by Docube or any other User of or visitor to the Site due to authorized or unauthorized use of their account as a result of User failure in keeping their account information secure and confidential. Use of another User’s Account information is expressly prohibited.

Additionally, you agree to indemnify Docube for any loss, damage, or liabilities arising out of the provision of any incorrect, untrue or inaccurate information while registration. Docube shall not be held liable for any consequences whatsoever resulting from such incorrect information.

CONDITIONS OF USE

You must be 18 years of age or older to be Registered User or visit or use the Website in any manner. By registering an Account, visiting and using the Website or accepting this Agreement, you represent and warrant to Docube that you are 18 years of age or older, and that you have the right, authority and capacity to use the Website and the services available through the Website, and agree to and abide by this Agreement. Docube may reject your application for an Account, or cancel an existing Account, for any reason, at our sole discretion.

You acknowledge that Docube will use the email address and/or phone number you provide on opening an Account or as updated by you from time to time as the primary method for communication with you (“Registered Email Address”) or (“Registered Phone Number”). You must monitor the Registered Email Address and Registered Phone Number you provide to Docube and your Registered Email Address and/or Registered Phone Number must be capable of both sending and receiving messages. Your email communications with Docube can only be authenticated if they come from your Registered Email Address and/or your Registered Phone Number.

You are responsible for keeping your password secure. Docube cannot and will not be liable for any loss or damage from your failure to maintain the security of your Account and password.

Technical support in respect of the services is only provided to Docube Users. Questions about the Terms of Use should be sent to the support team available at info@docube.in

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the service, use of the services, or access to the services without the express written permission by Docube.

You agree not to work around, bypass, or circumvent any of the technical limitations of the services, use any tool to enable features or functionalities that are otherwise disabled in the services, or decompile, disassemble or otherwise reverse engineer the services.

You agree not to access the services or monitor any material or information from the services using any robot, spider, scraper, or other automated means.

You understand that your User Materials may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. “User Materials” means your trademarks, copyright content, any photos, images, videos, graphics, written content, audio files, code, information, or other data provided or made available by you or your affiliates to Docube or its affiliates. You are responsible for your Account, the User Materials you upload to the Docube Site. If you violate Docube’s terms of service we may cancel your service access. If we need to reach you, we will communicate via the Registered Email Address and/or Registered Phone Number and you hereby provide the necessary consents and permissions for us to be able to do so. Such consents shall also apply to any appointment related reminders and allied communications that Docube may determine, in its sole discretion to be relevant for you.

DATA PRIVACY

Docube collects information relating to the devices through which you access the Website, location from which you access and anonymous data of your usage. The collected information will be used only for improving the quality of the Site and to build and offer any new services. Docube shall not be responsible in any manner for the authenticity or correctness of the personal information or sensitive personal data or information supplied by the User to Docube or to any other person acting on behalf of Docube. Docube may use such information collected from the Users from time to time for the purposes of debugging customer support related issues.

Docube may now or in the future provide services where you may be able to converse with Docube, its authorized representatives, its doctors or similar stakeholders via online chat, text messages, video call or voice call. When you choose this option, the records of such conversations, calls or exchanges may be recorded and stored in Docube’s servers. Such records are dealt with only in accordance with the terms of the Privacy Policy. Docube accepts no liability if you choose to use such a facility to interact with doctors or psychologists or if the facility is not used in accordance with the foregoing.

You may have access to a personal health record facility, if and when such a service is made available in the future, that allows you to add, edit, remove, and manage your health-related records and information at your sole discretion independently and voluntarily. This facility is only enabled or created for you after you have signed up and explicitly accepted these Terms.

Any Docube created information is provided on an as-is basis and Docube makes no representation in connection therewith. The accuracy, adequacy, reliability and liability of any User created information generated or created by a User is the sole responsibility of the User. You fully indemnify and hold harmless Docube with respect to any inaccuracies, inadequacy, error, loss, problem, liability or any other issue arising out of any User-created information entered or accessed by the You or on your behalf on the Website.

The personal health record facility, if and when such a service is made available in the future, might be provided on a best-efforts as-is basis. While we shall endeavour to strive to maintain the highest levels of service availability, Docube is not liable for any interruption that may be caused to your access of the Site or any services offered on the Site (if any).

If you provide anyone else access to your personal health record, when such a service is made available in the future, you shall be deemed to be responsible for all actions, access, transaction that that person takes related to your personal health record either on their own or independently. Docube are not responsible or liable for any action, transaction, loss, leakage or any other liability arising out of this.

LISTING CONTENT AND DISSEMINATING INFORMATION

Docube may collect and display on the Website, relevant information regarding the profile and practice of the doctors, psychologists and practitioners listed on the Website, such as their specialisation, qualification, fees, location, visiting hours, and similar details. Docube takes reasonable efforts to ensure that such information is updated at frequent intervals. Docube cannot be held liable for any inaccuracies or incompleteness represented from it, despite such reasonable efforts.

The Site is provided on an “as is” and “as available” basis, and without any warranties or conditions (express or implied, including the implied warranties of merchantability, accuracy, fitness for a particular purpose, title and non-infringement, arising by statute or otherwise in law or from a course of dealing or usage or trade). Docube do not provide or make any representation, warranty or guarantee, express or implied about the Website or any services offered therein. Docube does not guarantee the accuracy or completeness of any content or information provided by Users on the Website. To the fullest extent permitted by law, Docube disclaims all liability arising out of the User’s use or reliance upon the Website, the services (if any), representations and warranties on the Site, any content or information provided on the Website, or any opinion or suggestion given or expressed by Docube.

The Website may be linked to the website of third parties, affiliates and business partners. We want to clarify our approach regarding these links: Docube does not actively review or monitor the websites linked to our site, and thus, we do not endorse or assume responsibility for the content or policies of any other websites linked to or from our site. The inclusion of a link by Docube does not imply endorsement or establish a formal relationship between Docube and the operators of those websites. Your use of other websites linked to or from Docube is at your own discretion and risk, and Docube disclaims any liability related to your use of such external links or other websites. If Docube’s website contains a link to another website owned and operated by Docube, please note that the use of that website may be subject to different and additional terms of use and privacy policy terms and conditions. Docube assumes no responsibility, and shall not be liable for, any damages to, or viruses that may infect User’s equipment on account of User’s access to, use of, or browsing the Website or the downloading of any material, data, text, images, video content, or audio content from the Website. If a User is dissatisfied with the Website, User’s sole remedy is to discontinue using the Website.

If Docube determines through feedback or otherwise that you have provided fraudulent, inaccurate, incomplete or false information, Docube reserves the right to immediately suspend your access to the Website or any of your accounts with Docube and makes such declaration about suspension on the website alongside your name as determined by Docube for the protection of its business and in the interests of Users. You shall be liable to indemnify Docube for any losses incurred as a result of your misrepresentations or fraudulent feedback that has adversely affected Docube or its Users.

Information Disclaimer: The Content, text, data, graphics, images, information, suggestions, guidance, and other material (collectively, “Information“) available on the Website, including responses to your questions or postings, may be provided by individuals in the medical profession. No Endorsement: Mention of specific products, services, or any other Content on the Website does not constitute an endorsement or recommendation by Docube. Users should exercise their discretion and judgment when using or relying on such content

REPRESENTATIONS AND WARRANTIES

Subject to compliance with these Terms of Use, Docube grants Users a non-exclusive, limited privilege to access and use this Site. You agree to use the Site only: (i) for purposes that are permitted by this Terms of Use; and (ii) in accordance with any applicable law, regulation or generally accepted practices or guidelines.   • copy, republish, post, display, translate, transmit, reproduce or distribute any Docube property through any medium without obtaining the necessary authorization from Docube;
  • upload or distribute files or documents or videos (whether live or pre-recorded) that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of the Site or another’s computer;
  • upload or distribute files that contain software or other material protected by applicable intellectual property laws unless such Users own or control the rights thereto or have received all necessary consents;
  • attempt to gain unauthorized access to any portion or feature of the Site, any other systems or networks connected to the Site, to any Docube server, or through the Site, by hacking, password mining or any other illegitimate means;
  • probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site. You may not reverse look-up, trace or seek to trace any information on any other User, of or visitor to, the Site, to its source, or exploit the Site or information made available or offered by or through the Site, in any way whether or not the purpose is to reveal any information, including but not limited to personal identification information, other than Your own information, as provided on the Site;
  • falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;

Docube reserves its right to restrict, suspend or terminate your access or use of the Site for violation of any of the aforesaid restrictions or for any other unlawful or inappropriate conduct.

AVAILABILITY OF SITE

This Site is controlled and operated by Docube from India and Docube makes no representation that the materials are appropriate or will be available for use in other locations. If you use this web site from outside India, you are entirely responsible for compliance with all applicable local laws.

PERMISSION TO ACCESS SITE

Docube grants you a limited, revocable permission to access and make personal use of this Site, but not to download or modify it, its content or any portion of it, except with express written consent of Docube. This permission does not include any resale or commercial use of this Site or its contents; any collection and use of any Product listings, descriptions or prices; any derivative use of this Site or its content; any downloading or copying of account information for the benefit of another seller; or any use of data mining, robots, or similar data gathering and extraction tools.

Copyright: All Content included on the Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Docube, its affiliates or its content suppliers and is protected by the intellectual property laws of India.

EQUITABLE RELIEF
